These Terms of Use and Sale (“Terms”) govern your access to and use of the Eros USA Inc. website (the “Site”), as well as purchases made through the Site. In these Terms, “Eros USA,” “we,” “us,” and “our” mean Eros USA Inc.
By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.
The Site and our products are intended solely for adults. You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is greater, to access adult-oriented content or purchase products from us.
By using the Site, you represent that you meet these requirements, have not previously been suspended or removed from the Site, and will not permit a person who is under the legal age in their jurisdiction to access adult-oriented content through your account or device.
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and disclose personal information. The Privacy Policy is incorporated into these Terms by reference.
We may update these Terms from time to time. Updated Terms will be posted on the Site with a revised Effective Date. Changes apply prospectively from the date posted, unless otherwise required by law.
Your continued use of the Site after updated Terms are posted means you accept the updated Terms.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for lawful, personal, and non-commercial purposes.
You may not:
Copy, reproduce, republish, distribute, modify, display, sell, rent, license, or exploit Site content without our prior written permission;
Use our trademarks, logos, product images, or other brand materials without permission;
Scrape, crawl, harvest, mine, or use automated tools to access the Site or collect information from it;
Interfere with the Site’s operation, security, or other users’ access;
Attempt to gain unauthorized access to accounts, systems, or data;
Use the Site for unlawful, fraudulent, abusive, or deceptive purposes;
Use the Site or its content for commercial resale, advertising, or competitive purposes without our written consent; or
Remove copyright, trademark, or other proprietary notices.
We may suspend or terminate access to the Site if we reasonably believe you have violated these Terms or used the Site unlawfully.
The Site and its contents—including text, graphics, photographs, videos, product descriptions, designs, software, trademarks, logos, and other materials—are owned by or licensed to Eros USA and are protected by applicable intellectual-property laws.
Nothing in these Terms transfers ownership of any intellectual-property rights to you.
We try to present accurate product descriptions, pricing, availability, and images. However, errors may occur. We may correct errors, update information, limit quantities, refuse or cancel orders, or change prices at any time before shipment, including after an order is submitted.
Prices, promotions, and product availability may change without notice. We reserve the right to limit the quantity of any product or order.
We collect sales, use, and similar taxes when required by applicable law. Taxes shown at checkout may vary based on the shipping destination, product type, and applicable law.
An order is not accepted until we process it and prepare it for shipment. We may decline or cancel an order when permitted by law, including because of product unavailability, pricing or product-description errors, suspected fraud, or violation of these Terms.
Once an order has been placed, we may be unable to edit its items. If you need to remove an item, the order may need to be cancelled. If you wish to add an item, a separate order may be required. Where practical, we may combine shipments, but we do not guarantee that we can do so.
You may request cancellation before shipment tracking information has been confirmed. Once an order has been released for shipment or shipped, it cannot be changed or cancelled.
Address changes may be granted before shipping confirmation is issued. Please review your shipping address carefully and contact us promptly if it is incorrect.
Shipping times and delivery dates are estimates unless we expressly state otherwise. Delays may occur due to carrier issues, weather, customs, inventory, payment verification, or events outside our reasonable control.
Our shipping, international shipping, return, refund, and customs policies apply to applicable orders and are incorporated into these Terms. In general, returns must be unopened and unused and requested within 30 days of delivery. A 5% restocking fee may apply. Unauthorized returns may be refused or returned to sender at the customer’s expense.
For international orders, the buyer is responsible for applicable duties, taxes, import charges, customs brokerage fees, and other border-related charges. We cannot lower or alter customs declaration values.
If you enroll in an auto-ship or recurring-order program, you authorize us to charge your selected payment method at the frequency and price clearly disclosed at checkout, plus applicable taxes and shipping charges.
Before placing a subscription order, you will be shown the material terms of the program, including the recurring charge, frequency, and cancellation method.
You may cancel a subscription using the cancellation method provided at checkout or by emailing info@eroshim.com. To avoid the next scheduled shipment and charge, submit your cancellation request at least 48 hours before the next processing date. Cancellation requests received after an order has begun processing may apply to the following cycle.
The Site may contain links to third-party websites, services, payment providers, or shipping carriers. We do not control and are not responsible for third-party content, availability, policies, or practices. Your use of third-party services is governed by their own terms and privacy policies.
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” We do not guarantee that the Site will always be available, uninterrupted, secure, error-free, or free of harmful components.
Nothing in these Terms limits any consumer rights that cannot legally be excluded or limited.
To the fullest extent permitted by law, Eros USA and its officers, employees, affiliates, licensors, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site or purchase of products.
To the fullest extent permitted by law, our total liability for any claim relating to the Site or an order will not exceed the amount you paid to Eros USA for the applicable order giving rise to the claim.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Eros USA and its officers, employees, affiliates, and service providers from claims, damages, losses, liabilities, and expenses arising out of your unlawful use of the Site, your violation of these Terms, or your violation of another person’s rights.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York, unless applicable law requires otherwise.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our written consent; we may assign ours in connection with a merger, acquisition, sale of assets, or similar transaction.
